A BILL to amend and reenact section eleven, article two-a,
chapter seventeen of the code of West Virginia, one thousand
nine hundred thirty-one, as amended, relating to requiring
commissioner of division of highways to provide notice and
a chance to be heard to the residents of any city, town or
community, connected by a state road or highway, of the
proposed deletion of the name of the city, town or community
from the master road and highway map; and allowing any
resident of the city, town or community proposed to be
deleted from the map to petition the governor to overturn
the commissioner's decision to delete such name.
Be it enacted by the Legislature of West Virginia:
That section eleven, article two-a, chapter seventeen of the
code of West Virginia, one thousand nine hundred thirty-one, as
amended, be amended and reenacted to read as follows:
ARTICLE 2A. WEST VIRGINIA COMMISSIONER OF HIGHWAYS.
§17-2A-11. Road maps.




(a) The commissioner shall prepare and currently maintain a
master road and highway map which will show: (a) All of the
state roads and highways which have been located, created and
classified as provided by law; (b) the mileage of each
classification of roads and highways; and (c) the status of
improvement and, insofar as practicable, the travel condition
thereof. The commissioner may make economical reproductions of
such map from time to time for official use and public
information purposes.
(b) In no event may the name of any existing city, town or
community be removed from the master road and highway map without
the residents thereof first being provided notice by Class II
publication in a newspaper of general circulation in the city,
town or community intended to be removed. It shall provide an
address and set a time frame for the residents to submit written
comment to the commissioner in opposition to the proposed
deletion.
NOTE: The purpose of this bill is to require the
commissioner of the division of highways to provide notice and a
chance to be heard to the residents of any town or community,
connected by a state road or highway, of the proposed deletion of
the name of the town or community from the master road and
highway map.
